Terms and conditions

General

These general conditions of sale of the company 1010direct define the rights and obligations of the parties, hereinafter referred to as "Customer" on the one hand and on the other the 1010direct partnership, hereinafter referred to as "the website" through the sale of products and services to customers via the websites 1010direct.fr, 1010direct.com, 1010direct.co.uk, 1010direct.it, 1010direct.es, 1010direct.de and 1010direct.ch.

The customer declares to have read these terms and conditions of sale and accept the rights and obligations pertaining thereto. Any order made on the Website is governed by these terms.

These general conditions of sale apply without restriction or qualification to all sales concluded by 1010direct from a retail client wishing to purchase products offered for sale. These conditions relate exclusively to the non-commercial individuals.

1010direct and customers agree that their relations will be governed exclusively by this contract.

The Customer warrants that he/she is fully entitled to use the supplied credit/debit card for payment of his/her order and this card gives access to sufficient funds to cover all costs resulting from the use of 1010direct products.

A free quotation is supplied to the customer in the form of a summary of the order showing complete product/service descriptions and corresponding prices. The client accepts this quotation in accordance with legal provisions, by clicking on the payment authorisation button. The order will be final only after the authorisation of payment.

This validation is an electronic signature which has, among 1010direct and customers, the same value as a handwritten signature and is proof of the entire order and payment due pursuant to that order, as well as accepting full and unconditional acceptance of the entirety of these general conditions of sale.

Delivery and carriage

All deliveries will be sent via a free "signed for" service. Orders for home trial frames will also include a prepaid return envelope also using a "signed for" service. In most instances where glasses are ordered with prescriptions lenses your purchase will be despatched within 1-5 working days (Mon-Fri). In the case of specialist lenses (e.g. Tag Heuer) which are manufactured by individual designers, these will normally take 7-14 working days to despatch.

You will be notified by email at the time your goods are despatched.

If your goods are not delivered safely within a reasonable number of days of you receiving notification of despatch, you should contact us. Customers should promptly inspect goods delivered to them to satisfy themselves that any goods delivered to them are as expected.

In the case of non delivery, if either 1010direct or our courier is at fault, you will be offered the choice of a full refund or re-delivery.

7 day Home Trial Service

We offer a 7 day Home Trial service to enable you to check the look and feel of different frames before deciding which to buy. We charge a fee ("Home Trial Fee') for this service.

The frames will remain the property of 1010direct throughout the period of the Home Trial. When returning frames, you are requested to use the return packaging and prepaid address label provided.

1010direct will credit your account with each Home Trial Fee charged on return of the Home Trial order. These credits will then be redeemed as discounts again any future purchases (excluding further Home Trial Fees).

By submitting your request for a Home Trial, you are agreeing that if you do not return the frames sent to you in the Home Trial, within 7 calendar days following receipt by you then you will be charged the full price of the frames (less the Home Trial Fee already paid which will be given as a discount). The price of the frames will be the advertised price of the frames at the time you placed your Home Trial Order. To take payment, we will attempt to use the same payment card you used at the time of placing your Home Trial Order and your agreement of these Terms and Conditions is your authority for us to do so.

Once payment is successfully made you then own the frames. You then have the same right of return as if you had made any other purchase of goods (see Returns policy). Alternatively, for up to 7 days from the date you order the frames you may return one or more of your frames to us in order to have basic lenses fitted, free of charge, providing that we have already received payment for the frame(s).

Tax Charges

Currently all purchases have no VAT charged. This may well change in the near future, at which time VAT will be charged at the standard rate of 17.5% and will be included on all orders. At that time, we will publish a VAT registration number

Credit Card Security

All credit and debit card transactions are protected using 128 bit encryption from GeoTrust.

Your credit or debit card details are not stored following the online transaction. We simply retain an authorisation code from your card issuer.

What we do about mispricings

Despite our best efforts, there remains the possibility that catalogue items may be inadvertently mispriced. However, we do verify our prices as part of our despatch procedure. If an item's correct price is lower than our stated price, we will charge the lower amount and send you the item. If a product's correct price is higher than our stated price, we will cancel your order and notify you of that cancellation.
